1. Definitions

1.1 "Services" means the painting and related services provided by us as described in the quotation or proposal.

1.2 "Client", "you", "your" refers to the customer engaging our Services.

2. Quotations and Payments

2.1 Quotation: We will provide you with a written quotation specifying the scope of work, materials, and pricing.

2.2 Payment Terms: Our payment structure is as follows:

• Booking Fee: A 10% booking fee is required at the time of booking to secure your project in our schedule.

• Deposit: An additional 40% is due before the start of the project to cover initial preparation and materials.

• Remainder: The remaining 50% is payable upon completion of the project, ensuring your full satisfaction with our work.

• Late Payment: If payment is not made by the due date, we reserve the right to charge interest at 10% per annum on overdue amounts.

3. Client Responsibilities

3.1 Access: You agree to provide us with access to the property at agreed times for the purpose of performing the Services.

3.2 Preparation: You are responsible for preparing the premises, including moving furniture and personal items as necessary.

3.3 Cooperation: You agree to cooperate with us and provide any necessary information or approvals required for the Services.

4. Performance of Services

4.1 Schedule: We will use reasonable efforts to perform the Services within the agreed timeframe, subject to weather conditions and other factors beyond our control.

4.2 Changes: Any changes to the scope of work must be agreed upon in writing and may result in adjustments to the quoted price.

5. Warranty and Liability

5.1 Warranty: We warrant our workmanship for a period of 5 Years from completion, subject to proper maintenance and care.

5.2 Limitation of Liability: To the extent permitted by law, our liability for any claim arising out of or in connection with the Services shall be limited to the amount paid by you for the Services.

6. Termination

6.1 Termination by You: You may terminate the Services at any time by providing written notice. You will be liable for payment of Services provided up to the date of termination.

6.2 Termination by Us: We may terminate the Services if you breach these Terms or fail to cooperate, subject to any applicable notice period and your right to remedy the breach where possible.

7. Intellectual Property

7.1 Ownership: We retain ownership of any materials, designs, or intellectual property created or used in connection with the Services.

8. Dispute Resolution

8.1 Mediation: In the event of a dispute arising under these Terms, the parties agree to first attempt to resolve the dispute through mediation conducted in accordance with the rules of Australian Consumer Laws.

9. Governing Law

9.1 These Terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria.

10. Amendments

10.1 We may update these Terms from time to time. Any changes will be effective upon posting on our website. It is your responsibility to review these Terms periodically.
